1. Acceptance of these terms
By accessing or using joshpartist.com (the "Site"), you agree to these Terms and Conditions. If you do not agree with any part of them, please do not use the Site.
2. About the site
The Site is the official presentation page of the music artist Josh.P, operated by Josh.P / SwMusic (the "Operator"). It presents the artist's biography, press photographs, music and videos through embedded third-party players, a downloadable press kit, and links to official profiles and platforms.
The Site has no user accounts, no registration, no checkout, and no online store. Contact with the Operator is made only through the email addresses published on the Site.
3. Intellectual property
All content published on the Site — including music, recordings, photographs, images, texts, artwork, logos, and the Josh.P and SwMusic names and brands — belongs to Josh.P / SwMusic or is used with the permission of the respective rights holders, and is protected by applicable copyright and trademark laws.
Press kit exception. Materials included in the downloadable press kit (press photographs, biography, and related assets) may be used by media outlets, journalists, bloggers, promoters, and venues solely for editorial coverage of the artist Josh.P, provided that the artist is credited as "Josh.P" and the photographs are credited as indicated in the press kit where a credit is specified.
Any other use — including commercial use, reproduction, distribution, modification, resale, or use of the artist's name, image, music, or brand for any other purpose — requires the prior written permission of the Operator.
4. Third-party embeds and links
The Site includes embedded players and content from third-party platforms, in particular Spotify and YouTube, as well as links to external websites and social media profiles.
That embedded content and those external sites are provided and governed by the respective third parties under their own terms of service and privacy policies. The Operator does not control, and is not responsible for, the content, availability, or practices of third-party platforms or linked websites. Your use of them is at your own discretion and subject to their rules.
5. Acceptable use
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Site. In particular, you agree not to:
- Copy, scrape, harvest, or reproduce Site content beyond what these terms expressly allow;
- Use the Site or its content to misrepresent an affiliation with Josh.P or SwMusic;
- Attempt to interfere with the Site's operation, security, or availability;
- Use the Site for any fraudulent, harmful, or unlawful activity.
6. Website development
This Site was designed and built by Jorge Moisés Pasato, who is credited on the Site as the founder and builder of the SwMusic platform.
The design, layout, code, and technical implementation of the Site are the work of the developer. The development credit displayed on the Site ("Developed by Jorge Moisés Pasato" or equivalent wording) must remain visible and may not be removed, altered, or obscured in any copy, adaptation, or redeployment of the Site.
The developer is responsible for the technical creation of the Site only. The developer is not responsible for the artistic, commercial, or business content published by the Operator, nor for the Operator's activities, offers, agreements, or communications with third parties.
7. Limitation of liability
The Site and its content are provided "as is" and "as available", for general information and promotional purposes, without warranties of any kind, express or implied.
To the maximum extent permitted by applicable law, the Operator shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of, or inability to use, the Site or any third-party content embedded in or linked from it. Nothing in these terms limits liability that cannot be limited under applicable law.
8. Changes to these terms
The Operator may update these Terms and Conditions from time to time. The version in force is the one published on this page, with its "Last updated" date. Your continued use of the Site after changes are published constitutes acceptance of the updated terms.
9. Governing law and contact
These Terms and Conditions are governed by the laws of the State of New York, United States of America, without regard to its conflict-of-law principles.
